Please read these Terms and Conditions ("Terms") carefully before participating in the EARLY ADOPTER$ Non-Fungible Token ("NFT") Collection on the IOTA's Shimmer EVM Network ("Platform"). Your access to and use of the NFTs is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users and others who wish to access or use the NFTs.

1. Eligibility

You must be at least 18 years old to participate in the EARLY ADOPTER$ Collection. By agreeing to these Terms, you represent and warrant to us that you are at least 18 years old. If you are not yet 18, do not have the capacity to enter into contracts, or do not agree with all of the provisions of these Terms, do not access or use the NFTs.

2. NFT Ownership and Origin

These NFTs were issued as a free profile picture (PFP) artwork drop in appreciation to the long-term supporters of the IOTA's ecosystem. The recipient obtains all rights and ownership of the NFT upon receipt. The NFT represents digital ownership of dope skeleton art, stored on the IOTA's Shimmer EVM Network.

3. Intellectual Property Rights

These NFTs are issued under a Creative Commons Zero (CC0) license, which means they are effectively in the public domain, and can be used for free for any legal purpose. However, upon secondary sale of an NFT, a 1% royalty will be paid to the original artist.

4. Fear, Uncertainty, and Doubt (FUD)

While these NFTs were issued as a free art pieces, we acknowledge that some users may obtain them through secondary markets. We do not condone speculative trading or any form of market manipulation. Volatile price action on the secondary market could lead to negative behaviors and we strongly encourage responsible use of cryptocurrency technologies. The EARLY ADOPTER$ NFT Collection is about art, innovation, and community, not speculative investment.

Please note that there is no company or team backing this asset. The intellectual property rights are handed over to the users upon receipt, with no promises or guarantees made on our part. As a result, the EARLY ADOPTER$ NFT community is essentially "unfuddable". Any fear, uncertainty, and doubt (FUD) spread about this project is void and carries no weight. By using the NFT, you acknowledge and accept this condition.

5. Risks

You acknowledge and agree that the use of NFTs involves significant risks and potential for financial losses, including as a result of fluctuating cryptocurrency values, technological difficulties, or the unavailability of the Platform.

6. Liability

The EARLY ADOPTER$ Collection is provided "as is" and "as available," without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranty that might arise under any law.

7. Governance by EA$ DAO

The EA$ DAO is responsible for the governance and overarching decisions regarding the intellectual property rights and management of the EARLY ADOPTER$ NFT Collection as a whole. The EA$ DAO is composed of ten members: six core contributors and four community contributors and participants. EA$ DAO define how the four remaining governance tokens will be distributed.

Individual holders of NFTs from the EARLY ADOPTER$ Collection retain the rights and terms associated with their specific NFT artwork, as specified under these Terms. Such individual terms will not be affected or overridden by decisions made by the EA$ DAO. Participation or decisions made by the EA$ DAO only apply to the overarching direction and strategies of the collection, without infringing upon the rights granted to individual NFT holders.
